1.0 Our Products
1.1 Our Products featured on the website may vary from time to time and are available for delivery to most parts of the United Kingdom. Exclusions apply.
1.2 In the unlikely event that we experience supply problems we reserve the right to substitute either specific stems or a product of equal quality and financial value without notice
1.3 Freshness and longevity are important to us; to ensure we meet our own quality controls certain flower varieties may arrive in bud.
1.4 A small proportion of the varieties we use in our products maybe poisonous, if you have any concerns please do not hesitate to contact us.
1.5 Our Posy cards are delivered by Parcel Force and will arrive within 48 hours from the order date. –details are provided when placing your order.
1.6 Our Luxury Bouquets and Posy Cards are delivered next day unless another delivery date or service is selected.
1.7 We guarantee the longevity of your flowers for up to 5 days from the date of delivery subject to our care instructions being adhered to.
2.1 All product prices listed on our website include VAT at the standard rate. We reserve the right to change our prices at any time.
2.2 Delivery prices are included in our listed product prices unless otherwise stated. Exclusions apply during Peak trading periods which include, but not limited to; Christmas, Valentine’s Day and Mothers Day.
3.0 Placing an order and the payment process
3.1 Follow the clear step by step order process during which you will need to provide your full address and other contact details including your postcode and an active email address plus the details of the recipient. To ensure completion of the payment process you need to furnish all the necessary payment details.
3.2 We accept payment by all the major credit and/or debit cards.
3.3 To complete your order process you must accept out Terms & Conditions as they are defined here. This applies to all transactions
3.4 Automatically on completion of the order process a confirmation email is sent listing all relevant details including your unique order reference to your email address. The release of this email confirmation represents our acceptance of the order. If no email confirmation is received it is the customers responsibility to contact our call centre and request this confirmation. Please note that it is the responsibility of the customer to ensure that the details on your confirmation are correct. We cannot issue refunds on the basis of incorrect information entered at the time of order.
3.5 All customers must be 18 or over to place and order
4.1 We offer ONE MODE of delivery.
4.2 Delivery for all products is free unless otherwise stated for delivery Monday to Saturday.
4.3 Delivery for our Luxury Bouquets and Posy Cards is next day and is charged at £7.99 unless otherwise stated for delivery Monday to Saturday.
4.4 We do not recommend deliveries to hospitals as many hospitals do not accept flowers. Please note that no responsibility can be taken by us for non delivery due to refusal for whatever reason. Next day delivery services are not available for Hospitals.
4.5 Regional restrictions apply to specific products, these restrictions are usually made clear to you during the order process.
4.6 Next day courier delivery is not available for Scotland, Southern Ireland, Northern Ireland, Channel Islands, Scilly Isles, BFPO addresses & H.M. Prisons.
4.7 Courier deliveries are not available for delivery on Sundays and bank holidays, unless otherwise stated.
4.8 To ensure despatch and delivery within the next 24 hours, orders must be placed before 2pm between Monday and Friday. We make every effort to make sure that your delivery will arrive within 24 hours, however the exact delivery date cannot be guaranteed.
4.10 It is strongly recommended to avoid any problems that the full address details of the intended recipient and your contact details (daytime telephone numbers etc) are recorded in the unlikely event that we need to get in touch with you. It is at the discretion of the delivery driver to contact you in the event of any problems during the delivery of your product.
4.11 Multiple orders to the same address may be delivered at different times
4.12 A number of deliveries are made to third party locations such as offices, hotels, airports and other business locations. In these circumstances we accept the signature of authorised personnel at such premises as proof of delivery to the actual recipient. We cannot accept any responsibility for refusal of delivery at these premises. Please also note that deliveries can take place up to 19.00. It is the customers responsibility to ensure that someone is at the property to take receipt of the package. No refunds will be issued due to non response at specified address.
4.13 Our deliveries are made in good faith on the basis of the information provided when the order is placed, we do not accept responsibility for refusal of the delivery for whatever reason or inaccurate address details. If a delivery is refused, this is the responsibility of the sender and no refund will be available.
4.14 If in the unusual circumstances that we are unable find someone to accept a delivery or subject to the discretion of delivery person leave the item / items in a secure location a card will be left at the premises with instructions and contact details of the local depot to re arrange delivery. We reserve the right to charge for any re delivery if the recipient does not make contact within a reasonable period of time.
4.15 We shall not be liable for any non delivery or failure of other contractual obligations as a result of Acts of God (including fire, flood, earthquake, storm, hurricane or other natural disaster), war, invasion, act of foreign enemies, hostilities (whether war is declared or not), civil war, rebellion, revolution, insurrection, military or usurped power or confiscation, terrorist activities, nationalisation, government sanction, blockage, embargo, labour dispute, strike, lockout or interruption or failure of electricity or telephone service.

Please note that the Customer Contact Centre can only take orders, amend orders and take messages all comments and complaints need to be addressed by our customer services team.
5.3 We want to resolve any complaint as quickly as possible to your satisfaction. Because all our products are perishable we strongly suggest that if you have a complaint please get in touch within one day of the designated delivery day. Unfortunately no refunds or replacements can be issued without evidence that the product has arrived in poor condition.
6.0 Cancellations and Amendments
6.1 We need 72 hours before the delivery date to be able to cancel or amend any confirmed order. If you wish to cancel or amend an order please call our Customer Contact Centre or alternatively email firstname.lastname@example.org
6.2 You are entitled to cancel any payment at any time where fraudulent use has been made of your credit or debit card by another person not acting on behalf of you or as your agent and to be re-credited by us to the extent that such sums are not reimbursed by the card issuer in such circumstances.
7.1 We agree to use all reasonable endeavours to ensure that our website www.flowerinnovations.co.uk is fully operational and error-free. Unfortunately we cannot always guarantee this and therefore, accept no responsibility for any defects and/or interruption of flowerinnovations.co.uk and shall be released from our obligations under these Terms and Conditions in the event of any cause beyond our reasonable control which renders the provision of our website www.flowerinnovations.co.uk impossible or impractical.
7.2 (a) We accept no liability for death or personal injury arising from our negligence.
7.2 (b) Subject to clause 7.2(a), our liability in contract, tort (including negligence and breach of statutory duty) or otherwise arising by reason of or in connection with your order with us shall be limited to a multiple of  times the price you have paid for the products.
7.2 (c) Subject to clauses7.2(a) and 7.2(b) above we exclude all liability for any claims, losses, demands and damages, including without limitation, any costs, loss of profits, loss of contracts or business opportunity, loss of data and any other consequential, incidental, special or punitive damages, even if we have been advised of the possibility of such damages, arising directly or indirectly out of or in any way connected with your use or inability to access the Flower Innovations website, whether arising in contract, tort (including negligence), under statute or otherwise PROVIDED THAT nothing contained in these Terms and Conditions affects or will affect your or the recipient's statutory rights in relation to the quality, fitness or description of the products supplied.
7.2 (d) Subject to the relevant clauses we shall not be liable for any delay or inability to perform our obligations to you if such delay is due to any cause whatsoever beyond our reasonable control.
8.0 GENERAL TERMS
8.1 We reserve the right to supplement and amend the Terms and Conditions on which you are permitted access to the Flower Innovations website and services from time to time. We will post any changes on the Flower Innovations website and it is your responsibility as a customer to review the Terms and Conditions on each occasion you access the Flower innovations website. Any changes that are made to the Terms and Conditions will be effective in six (6) hours after the posting of any such change and all subsequent dealings between you and us shall be on the new terms and conditions.
8.2 Additionally, we reserve the right to suspend, restrict or terminate access to the FLOWER INNOVATIONS website Site for any reason at any time.
8.3 These Terms and Conditions shall be deemed to include all other notices, policies, disclaimers and other terms contained in the Flower Innovations website, provided that in the event of a conflict between any such other notices, policies, disclaimers and other terms, these Terms and Conditions shall prevail. If any of these Terms and Conditions is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
8.5 A person who is not a party to the agreement between you and us has no rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any of the Terms and Conditions but this does not affect any right or remedy which exists apart from that Act.
8.6 In respect of fraudulent misrepresentation, this agreement (including any documents and instruments referred to herein) supersedes all prior representations, arrangements, understandings, and agreements between you and us (whether written or oral) and sets forth the entire agreement and understanding between you and us relating to the subject matter hereof.
8.7 Your purchase will be deemed to have occurred in the UK. These Terms and Conditions shall be governed by and construed in accordance with English Law and the parties agree to submit to the exclusive jurisdiction of the English courts.

9.1 All other rights, including copyright, in this website are owned by Flower Innovations Limited . Any use of this website or its contents, including copying or storing it or them in whole or part, other than for your own personal, non commercial use is prohibited without the express permission of Flower innovations Limited . You may not modify, distribute or repost something on this website for any purpose.
10.0 Account & Registration services
10.1 When you place an order with us you are required to register, this requires the creation of a password. You must keep this password confidential and must not disclose it or share it with anyone. You will be responsible for all activities and orders that occur or are submitted under your password. If you know or suspect that someone else knows your password you should notify us immediately. Should you forget your password, please use the password reminder service
10.2 If Flower Innovations believes that there is likely to be a breach of security or misuse of the Service or site, we may require you to change your password, or may suspend use of the Service.
10.3 It is important to make sure that the details you provide at any time are correct and complete.
10.4 We at all times want to make sure that we provide the very best service. It is important to us that the information we hold is accurate and up to date. Please get in touch if any of the information that we hold about you is incorrect or needs updating, or if you want us to delete any personal information.
10.5 We adhere to the obligations in relation to your personal information under the Data Protection Act 1998.
